so here's my story ... and you know i always have one.

in march 2002 i moved to eastchase terrace apartments in fort worth on eastchase parkway and i-30. they are managed by rca holdings of houston, texas. i lived there until aug. 31, 2004. while there i always had to park an unreasonable distance from my apartment unit because parking was so scarce. i had a leaky roof that leaked on my bed until i realized they were never really going to fix it. so i rearranged my bedroom so the leak would drip directly on the carpet. i wrote several letters of complaint to the leasing and corporate office about these issues. i was finally forced to call the city of fort worth. i think they were eventually cited.

now if i was really smart when i gave my 30 days notice, i should have paid my last month's rent less my deposit because i knew these people hated me and weren't going to give my deposit back. i know that's not legally right, but i should have been street-smart. however, i knew i was in the right and i thought if i trusted in god that everything would turn out okay.

so i evacuated that horrid place called a residence and moved to a much better place. after several weeks i was told (and sent in writing) i would be received $221.96 from my deposit. initially i paid $300 ($100 for my unit and $200 for pet deposit). the $100 was completely refundable and $150 was refundable from the pet deposit. fair enough, i was supposed to get $250 back, however they deducted $28.04 for my water usuage for the last month. still, fair enough.

but now, it's been 73 days and i have yet to receive the check from the corporate office. texas law states that they must provide the money or a reason why i don't get the money within 30 days of my move-out, so yes, they are breaking the law. i have been told it's being mailed. yesterday they finally told me it has been cut but not signed. after some threatening of reporting them to the attorney general and better business bureau (which i've already done), i was told today that my check would be released and mailed this coming tuesday (for some reason i'm not holding my breath but i am going to try to be positive). at this point i've spent more energy, time and frustration than the $200 bucks is worth, but i just feel that i am right in this and it's all based on principle. so i will continue to argue and bug these people until i get what's due to me.

in addition to those funds state farm owes me $45 for an insurance payment refund.

just a sidenote, i think god is trying to teach me something here. i just haven't figured it out yet. my 7th grade math teacher always used to say "life is hard, then you die." there's some words of wisdom for ya!

    Keep it up. The squeakiest wheel gets oiled. It is sad but that is how things are. If you don’t complain and follow up a lot of companies will let things fall through the cracks. It all adds up to a nice little profit at the end of the year when they write it all off to uncollected refunds.

    They did that to me when I left NY. I finally sent them stuff with legal letterhead, wrote Esq after my name, and had them call the firm (not my direct line) for them to get the hint. I hate places that try to take advantage of 100% of their former residents b/c 50% will just give up.
